1. Introduction
 
DKK Creative ("DKK Creative", "we", "our", or "us") is an AI-Driven Creative and Marketing Agency based in Nashik, Maharashtra, India.
 
We invest significant time, creative effort, software licenses, AI processing costs, planning resources, and professional expertise into every project. This policy explains how cancellations, refunds, project pauses, and payment-related matters are handled across all services provided by DKK Creative.
 
2. Advance Payment Policy
 
To reserve project resources and begin work, an advance payment is required for most services.
Advance payments may be used for:
 

  • Project planning

  • Research and strategy

  • Creative development

  • Design work

  • AI generation and testing

  • Team allocation

  • Software licensing

  • Administrative costs

  • Infrastructure and operational expenses
     

Once project work has commenced, advance payments are generally non-refundable.
 
3. Cancellation Before Work Begins
 
If a client requests cancellation before any project work has started, DKK Creative may review the request on a case-by-case basis.
 
Administrative, consultation, transaction, and payment processing costs may still be deducted.
 
DKK Creative reserves the right to determine whether project work has commenced.
 
4. Cancellation After Work Has Started
 
Once any work has begun, including:
 

  • Consultation

  • Strategy

  • Research

  • Design

  • Development

  • AI generation

  • Website setup

  • CRM setup

  • Automation setup

  • Custom GPT setup

  • Marketing setup

  • SEO setup the project shall be considered active.

 
No refund shall be issued for completed work, partially completed work, or resources already consumed.
 
5. Project Pause vs Project Cancellation
 
Project Pause
 
A project may be paused by mutual agreement.
 
Additional fees may apply if the pause significantly impacts timelines, team allocation, or project resources.
 
Project Cancellation
 
A project is considered cancelled when:
 

  • The client formally requests cancellation; or

  • DKK Creative terminates the project under this policy.
     

Cancellation does not automatically qualify for a refund.
 
6. Project Abandonment
 
If a client remains unresponsive for more than thirty (30) consecutive days despite reasonable follow-up attempts, DKK Creative may classify the project as abandoned.
 
In such cases:
 

  • Work may be paused or terminated.

  • Files may be archived.

  • Reactivation charges may apply.

  • No refund shall be issued.
     

7. Website & Service Suspension Due to Non-Payment
 
If agreed payments are not completed within the agreed timeline, DKK Creative reserves the right to:
 

  • Pause work

  • Restrict access

  • Delay delivery

  • Suspend services

  • Unpublish websites

  • Disable project assets where legally permissible
     

Any payments already made shall remain non-refundable.
 
Outstanding balances remain payable.
 
8. AI Cinematic Video Services
 
AI video projects involve:

  • AI generation costs

  • Rendering costs

  • Editing costs

  • Production costs

  • Software licensing costs
     

Once generation, rendering, editing, or production work begins:
 

  • Orders cannot be cancelled.

  • Payments become non-refundable.

  • Delivered outputs are non-refundable.
     

9. AI Voice Calling Services
 
DKK Creative may assist clients in setting up, configuring, managing, or deploying AI Voice Calling solutions through third-party providers.
 
DKK Creative does not own or operate the underlying AI voice calling infrastructure.
 
Voice services may be powered by external providers whose pricing, limits, availability, and policies are outside DKK Creative's control.
 
Once setup, configuration, scripting, integration, testing, deployment, or training work begins:
 

  • Setup fees become non-refundable.

  • Configuration fees become non-refundable.

  • Integration fees become non-refundable.
     

If a client purchases a voice calling package that includes a monthly allowance (for example, 750 minutes per month), unused minutes may be:
 

  • Carried forward to the next billing cycle,

  • Converted into service credit,

  • Refunded proportionally, only where permitted by the underlying third-party provider.
     

Unused minutes may be carried forward, credited, or refunded at DKK Creative's discretion and subject to the policies of the underlying provider.
 
DKK Creative cannot guarantee refunds or rollovers if the provider does not support them.
 
10. Custom GPT Development
 
DKK Creative provides Custom GPT setup, prompt engineering, knowledge-base preparation, workflow design, testing, deployment, and integration services.
 
DKK Creative does not provide ownership of OpenAI, Google Gemini, Anthropic Claude, or any third-party AI platform subscriptions.
 
Clients remain responsible for maintaining any required subscriptions including:
 

  • ChatGPT Plus

  • ChatGPT Team

  • ChatGPT Enterprise

  • Google Gemini

  • Claude

  • Other AI platform subscriptions
     

DKK Creative's fees cover setup, customization, deployment, and implementation only.
 
Any subscription fees charged by AI providers remain the client's responsibility.
 
Once Custom GPT setup, configuration, testing, deployment, or knowledge-base preparation begins:
 

  • Payments become non-refundable.

  • Setup fees become non-refundable.

  • Development fees become non-refundable.
     

Client-owned data remains the property of the client.
 
11. AI CRM, AI Web Apps & Automation Projects
 
For AI CRM systems, AI web applications, automations, integrations, and custom workflows:
 

  • Planning costs are non-refundable.

  • Development costs are non-refundable once work begins.

  • API consumption costs are non-refundable.

  • Third-party software fees are non-refundable.
     

Partially completed work may still be billed based on progress achieved.
 
12. Third-Party Costs & API Charges
 
DKK Creative may utilize third-party services including:
 

  • OpenAI

  • Anthropic

  • Google

  • Meta

  • WhatsApp Business

  • Zoho

  • Make.com

  • Wix Studio

  • Hosting providers

  • Domain registrars
     

Any costs already incurred through these services are strictly non-refundable.
 
This includes:
 

  • API usage

  • AI credits

  • Hosting fees

  • Domain fees

  • Automation usage

  • Subscription costs
     

13. Pricing Fluctuation Policy
 
Third-party providers may revise pricing at any time.
 
If operational costs increase due to:
 

  • OpenAI pricing changes

  • Anthropic pricing changes

  • Meta pricing changes

  • Google pricing changes

  • WhatsApp pricing changes

  • Hosting cost increases

  • Software subscription increases
     

DKK Creative reserves the right to revise service pricing or request additional payment to continue services.
 
No refund shall be issued due to such pricing changes.
 
14. SEO, GEO, Advertising & Marketing Services
 
Marketing performance depends on multiple external factors including:
 

  • Search engine algorithms

  • Social media algorithms

  • Market competition

  • Audience behavior

  • Ad budgets

  • Platform policies
     

SEO rankings, GEO visibility, ad performance, leads, conversions, engagement, and business outcomes cannot be guaranteed.
 
Once marketing services begin:
 

  • Fees become non-refundable.

  • Management charges become non-refundable.
     

15. Logo, Branding & Design Services
 
Logo design, branding, packaging, and creative services involve significant creative effort.
 
Once concepts, drafts, previews, or creative directions are delivered:
 

  • Payments become non-refundable.

  • Design services become non-refundable.
     

Additional revisions beyond the agreed scope may incur additional fees.
 
16. Domain, Hosting & Third-Party Purchases
 
Any purchases made on behalf of clients including:
 

  • Domains

  • Hosting

  • SSL certificates

  • Business email services

  • Plugins

  • SaaS subscriptions

  • Premium software licenses are governed by the policies of the respective provider and are strictly non-refundable.

17. Creative Satisfaction Clause
 
DKK Creative aims to achieve client satisfaction through the agreed revision process.
 
If all included revision rounds are exhausted and the client remains dissatisfied:
 

  • No refund shall be issued.

  • Additional revisions may be chargeable.

  • DKK Creative may, at its sole discretion, offer a goodwill credit note toward future services.
     

Such credits are optional and not guaranteed.
 
18. Approved Refund Timeline
 
If a refund is approved under exceptional circumstances:
 

  • Refunds shall generally be processed within 7–15 business days.

  • Banking and payment processing timelines may vary.
     

19. Payment Processing & Refund Handling
 
Payments may be processed through:
 

  • Cashfree

  • UPI

  • Bank Transfer
     

If a refund is approved:
 

  • Refunds will generally be processed through the original payment method where possible.

  • Processing timelines remain subject to Cashfree, banks, UPI providers, and financial institutions.
     

DKK Creative shall not be responsible for delays caused by payment processors, banks, or financial institutions.
 
20. Client Delay Clause
 
If delays occur because of:
 

  • Missing content

  • Delayed approvals

  • Delayed feedback

  • Communication gaps

  • Internal client decisions project timelines may be extended accordingly.
     

Such delays do not qualify for refunds.
 
21. Limitation of Refund Rights
 
No refunds shall be provided for:
 

  • Completed work

  • Approved deliverables

  • Delivered AI outputs

  • Consumed AI credits

  • Consumed API usage

  • Consulting services

  • Strategy sessions

  • Domain purchases

  • Hosting purchases

  • Third-party subscriptions

  • Custom GPT setup already started

  • AI Voice setup already started

  • Automation projects already started
     

22. Governing Law & Jurisdiction
 
This policy shall be governed by the laws of India.
 
Any dispute arising from payments, cancellations, refunds, or services shall first be attempted to be resolved through mutual discussion.
 
If resolution cannot be achieved, the matter shall be subject to the exclusive jurisdiction of the courts located in Nashik, Maharashtra, India.
