These Terms & Conditions govern all services provided by DKK Creative, including website development, AI solutions, branding, marketing, automation, advertising, and consulting services.

By purchasing, using, or engaging with any DKK Creative service, you agree to these Terms & Conditions.

2. Services

DKK Creative provides services including but not limited to:

All services are provided according to the agreed project scope, proposal, quotation, invoice, or written communication.

3. Pricing, Payments & Renewals

​

An advance payment may be required before work begins.

​

Unless otherwise agreed in writing:

​

  • Advance payments are non-refundable.

  • Remaining payments must be completed according to the agreed schedule.

  • Additional features outside the agreed scope may incur additional charges.

  • Animated websites, additional languages, extra products, advanced integrations, and custom functionality may require additional fees.

Where applicable:

​

  • Domain renewals are the client's responsibility after the initial term.

  • Hosting renewals are the client's responsibility after the initial term.

  • Maintenance services beyond the included period require separate renewal fees.

DKK Creative reserves the right to suspend services for overdue payments.

​

4. Project Scope, Revisions & Client Responsibilities

​

Clients are responsible for providing content, approvals, credentials, feedback, and required information in a timely manner.

 

Project delays caused by the client may result in timeline extensions.

​

Unless otherwise agreed:

​

  • Revisions are limited to the agreed scope.

  • Major redesigns after approval may incur additional charges.

  • Additional revision rounds may be chargeable.

​

All approval confirmations provided through WhatsApp, email, project management tools, or other written communication shall be considered final approval.

​

Any commitments not documented in writing shall not be considered binding.

​

5. Website, Hosting & Platform Policies

​

Reference websites are used only for inspiration, layout guidance, or functionality discussion.

​

DKK Creative does not guarantee duplication of any third-party website.

​

Package limits regarding pages, products, languages, integrations, booking systems, or functionality must be respected unless additional services are purchased.

​

If a website goes live and agreed payments remain outstanding, DKK Creative reserves the right to suspend, restrict, or unpublish the website until payment obligations are fulfilled.

6. AI Services

​

DKK Creative provides AI-powered services including:

​

  • AI Cinematic Videos

  • AI Voice Calling Solutions

  • Custom GPT Development

  • AI CRM Systems

  • AI Web Applications

  • AI Automations

​

DKK Creative may use third-party AI providers including OpenAI, Google Gemini, Anthropic, and other technology providers.

​

DKK Creative does not own these platforms and cannot guarantee uninterrupted service, model availability, accuracy, or future pricing.

​

For Custom GPT projects, DKK Creative charges for setup, customization, deployment, and implementation. Ongoing subscriptions required by AI providers remain the client's responsibility.

​

For AI Voice Calling projects, DKK Creative may assist with setup and deployment through third-party providers. DKK Creative does not own the underlying voice infrastructure.

​

Unused voice calling minutes, credits, or allowances may be carried forward, credited, or refunded only where permitted by the underlying provider.

​

AI Credits, Usage Limits & Third-Party Platform Dependency

​

Certain AI-powered solutions developed by DKK Creative, including AI CRM Systems, AI Web Applications, Custom AI Tools, AI Assistants, and Automation Platforms, may be built using third-party providers and platforms such as Base44, OpenAI, Anthropic, Google Gemini, Make.com, and other AI service providers.

​

These platforms may operate using usage-based pricing models, credits, tokens, requests, API calls, storage limits, workflow executions, or other resource consumption mechanisms.

​

Where applicable, project proposals, quotations, invoices, service agreements, or package details may specify included AI usage limits, monthly credits, monthly requests, monthly conversations, storage limits, or other usage allowances.

​

AI usage consumption depends on various factors including:

​

  • Number of users

  • Number of requests

  • AI model usage

  • Data processing volume

  • Workflow complexity

  • Automation frequency

  • Storage usage

  • Third-party platform billing policies

​

If the included monthly AI usage limit, credit allocation, token allowance, conversation allowance, request limit, or platform quota is exhausted, additional charges may apply.

​

DKK Creative shall not be responsible for service limitations, interruptions, reduced functionality, additional costs, platform restrictions, or temporary suspension resulting from exhaustion of included usage limits or third-party platform quotas.

​

Clients remain responsible for any additional usage fees, subscription upgrades, credit purchases, platform charges, or resource consumption costs required to continue service operation beyond the included allocation.

​

DKK Creative does not control and cannot guarantee the future pricing, quotas, policies, uptime, or limitations imposed by third-party providers including Base44, OpenAI, Anthropic, Google Gemini, Make.com, hosting providers, or other technology vendors.

 

7. Intellectual Property Rights

​

Upon full payment of the agreed project fees, the client receives ownership rights to the final approved deliverables unless otherwise specified in writing.

​

DKK Creative retains ownership of:

​

  • Internal workflows

  • Methodologies

  • Templates

  • Frameworks

  • Proprietary processes

  • Pre-existing intellectual property

​

Clients warrant that any content, logos, images, videos, trademarks, or materials supplied by them are owned by them or properly licensed.

​

The client remains responsible for any copyright or trademark issues arising from client-provided materials.

​

8. Marketing, SEO, GEO & Performance Disclaimer

​

Marketing results depend on numerous external factors beyond DKK Creative's control.

​

DKK Creative does not guarantee:

​

  • Search engine rankings

  • GEO visibility

  • Lead generation volume

  • Sales volume

  • Ad performance

  • Conversion rates

  • Social media growth

  • Business revenue

  • AI-generated output accuracy

​

Performance may vary depending on budgets, competition, market conditions, algorithms, and third-party platform policies.

 

9. Third-Party Services & Dependencies

​

DKK Creative may utilize third-party platforms including:

​

  • Wix Studio

  • OpenAI

  • Google Gemini

  • Anthropic

  • WhatsApp Business

  • Zoho CRM

  • Make.com

  • Google

  • Meta

  • Cashfree

  • Hosting Providers

  • Domain Registrars

DKK Creative shall not be responsible for downtime, outages, pricing changes, policy updates, account suspensions, API limitations, or service interruptions caused by third-party providers.

​

If third-party costs increase, DKK Creative reserves the right to revise pricing or request additional payment to continue service delivery.

 

10. Limitation of Liability

​

To the maximum extent permitted by law, DKK Creative shall not be liable for any indirect, incidental, consequential, special, or business-related damages arising from the use of our services.

​

Total liability, if any, shall not exceed the amount actually paid by the client for the specific service giving rise to the claim.

 

11. Termination, Suspension & Refunds

​

DKK Creative reserves the right to suspend, pause, or terminate services if:

​

  • Payments remain outstanding

  • The client violates these Terms

  • Required cooperation is not provided

  • Additional charges remain unpaid

  • Fraudulent or unlawful activities are suspected

​

Refund eligibility shall be governed by the DKK Creative Refund & Cancellation Policy available on our website.

​

12. Governing Law, Updates & Contact Information

​

These Terms & Conditions shall be governed by the laws of India.

​

Any disputes arising from these Terms or our services shall first be attempted to be resolved through mutual discussion.

​

If resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in Nashik, Maharashtra, India.

​

DKK Creative may update these Terms & Conditions from time to time. Continued use of our services after such updates constitutes acceptance of the revised Terms.
